He also skewers the contingent of lawyers and academics who resist such changes in the name of precision and lampoons flaws in the legal system, such as judges' refusal to explain instructions to jurors who are mystified by phrases such as Circumstantial evidence is evidence that, if found to be true, proves a fact from which an inference of the existence of another fact may be drawn. Adam Freedman writes the “Legal Lingo” column for the New York Law Journal Magazine, and was a litigator before joining a major investment bank where he earns his living decoding policies and procedures into plain English. In a perfect world this book would be required reading

"The Party of the First Part" is an erudite, hilarious tour through 21st Century American legalese. Alan Freedman leads us through the ankle-grabbing underbrush of redundancy, dead phrases, faux Latin, and mindless obfuscation into which every reader - and writer - of legal documents eventually must stagger.

Freedman is a sure-footed guide who knows the territory. Time and again, he yanks up a hoary word or phrase and shows us its tangled roots.

Sometimes we find, clutching a root with a deathgrip, an advocate of the so-called "Precision School" of legal drafting. These lawyers and profs fear that awful chaos would result if lawyers quit using ancient Anglo/French/Latin phrases, in favor of words used by 21st Century Americans in everyday life. Chaos? Well gosh, people might have to *sue* if they can't agree what a word or phrase written in 21st Century English means. Uh-huh, thinks I: as if they aren't already suing by the thousands over the meaning of Roman-numeraled legal documents bristling with boilerplate clunkers such as "witnesseth," "hereinabove," "aforementioned," "covenant and agree," and "hereunto."

This book should be required reading for every law student, law professor, judge and lawyer in the United States. It encourages those among us who want to write clearly when drafting legal documents. I hope it will at least give pause for thought to our colleagues who never met a hundred-word clause in the passive voice, that they didn't like.

the humorous side of legalese

This book is a funny and expansive look at the origin of legal terms and obscure laws, ranging. Although a fun read, the book seemed to lack focus. At times, it read as an advocacy piece encouraging the legal community to abandon traditional legalese, supported by what is inexplicably called "The Precision School", in favor of simple and widely accessible plain English, supported the "The Plain English School." At other times, the agenda seemed to be purely entertaining or educational. Perhaps all three.

My reaction to this book varied as I was reading it. Parts are laugh-out-loud funny. The author's treatment of sex laws and laws regulating sales of sex toys is as entertaining as any stand-up comedian`s monologue. For example, in describing an Alabama court's 2004 decision that "ordinary vibrators" not designed primarily for genital stimulation are not impermissible sex toys, the author notes that this leaves the door wide open for the "sale of vibrators designed primarily for making cappuccino." He notes that North Dakota's sodomy laws specifically prohibit copulation with a bird, and catalogues the various (and often humorous) terms used to describe impermissible sex acts in throughout the US.

Alternately, sections of the book are a little tedious, with broad-brush descriptions of term after legal term. The author is quite witty, but occasionally the wit teeters on the edge of sarcasm and sophomoric humor. Throughout the book, he uses little snippets of created dialogue that show the humor of a particular usage in a particular setting. Some are funnier than other.

There is much to be learned here. The author tells the stories of the origins of negligence-based tort liability (an engineer named MacAdam, who developed a system for paving), He draws from ages-old legal cases from the US and UK, and isn`t afraid the identify the judge or court responsible..

WHAT I LIKED: Overall the book is funny, full of information, seemingly well-researched, and nicely indexed. I read a lot and often don't notice, or am critical of the font and presentation. The presentation is also very visually appealing. The font, page layout, and paper quality are nice.

WHAT I DIDN'T: Occasionally tedious, references are not cited

Overall, I would recommend this book to collectors of legal trivia or anyone interested in understanding legalese or learning about the origin of legal terms.

A slim volume, packed with interest. The chapter on Wills, Wives and Wrecks is worth the price of admission. Are you sure that your will can pass the Fertile Octogenarian Rule?
Adam Freedman has assembled a menagerie of legal expressions, many dating back to Norman French, with very specific meanings forged in thousands of judge's decisions. It's tempting to scorn legalese as a way for lawyers to obscure what they're up to, but the truth is that careful use of legal terms is a vital part of our justice system. This book is well indexed if you just need to consult it in a pinch, but it's so entertaining that you'll want to read every word.

About the Author

Professor TIM FLANNERY is a leading writer on climate change. A Scientist, an explorer and a conservationist, Flannery has held various academic positions including Professor at the University of Adelaide, Director of the South Australian Museum and Principal Research Scientist at the Australian Museum. A frequent presenter on ABC Radio, NPR and the BBC, he has also written and presented several series on the Documentary Channel. His books include Here on Earth and the international number one bestseller The Weather Makers. Flannery was named Australian of the Year in 2007.

Not Just Dots on a Map

This is the memoir of an Australian naturalist who, twenty years ago, made the effort to find and study mammals on remote Pacific islands before they became extinct. If he could discover them, then they could be protected.
The man has a sense of humor - - -and he needed it to deal with the native peoples who still live traditional lives among the coconut trees... . but he also had to deal with environmental disruption and exploitation of the forests, which made the finding of obscure species almost impossible.
He also had a brush with a cannibal culture of not too long ago - - in Fiji. Not for the squeamish to read the account of a missionary of 100 years ago.
This is a lively read.....Australians are almost always entertaining.

Perfect for the Armchair Traveler

The description and the two reviews I've read say it all very well. How neat to be able to visit these remote islands--without the inconvenience of travel, bugs, snakes, diseases and enervating tropical heat! The movie "PT-109" showed these beautiful places and the gorgeous pacific. And a long time ago I read a book by Charis Crockett, an anthropologist in New Guinea, called "The House in the Rain Forest". She typed much of her book with a tree kangaroo on her shoulder. Fascinating places with an amazing variety of flora and fauna. I highly recommend both books.

My only complaint is the shortage of photos! How I'd love to see the coral and colorful fish, the birds, more flowers, and views of the rain forests! The native people are interesting, the bats and rats are cute (I suspect that it would take a zoologist to call them beautiful as he does) and I'm glad he included the pictures. But five or ten times that many would have made a really superior book. I bought this thru Amazon.

Past and present on Pacific Islands

Flannery, an Australian writer, scientist, and explorer, recounts his adventurous travels to some islands off New Guinea to take stock of their mammalian fauna (existing or extinct). It was not always easy to deal with the natives but Flannery and his team took all difficulties in stride and with great humor. They visited the Bismarck Islands, Solomon Islands, Fiji, and New Caledonia. They were especially interested in endemic species of bats, including flying foxes, and unique species of rats. Unfortunately civilization with the introduction of our rats, cats, pigs, and dogs together with deforestation and mining has brought to extinction the unique giant rat and other mammals endemic to these islands.

Pattern Recognition Guidance

"Trade What You See" is an excellent guide to help traders filter through market volatility and media hype. Jouflas' and Pesavento's latest offering is a concise overview of how to look at the markets and identify high probability, low risk trade opportunities. From Fibonacci ratios, AB=CD patterns, to trade management and trading plan, any trader can supplement their own trading style with the basic trade guidelines outlined in this book.

As another review of this book has pointed out, the section "Learning to Recognize Trend Days" is very valuable. This section can be helpful to any trader to take advantage of trend day opportunities. The section is invaluable for countertrend traders who have not yet developed a strategy to recognize and trade trend days. At the very least, simply identifying a trend day can keep a countertrend trader from getting caught in low probability trade situations. Jouflas takes you through multiple steps of a trend day enabling a trader to more easily assess what is happening.

Disclosure: I have followed both Leslie Jouflas and Larry Pesavento for several years. Even so, in reading this book, I found myself brushing up on some areas. Especially the "Trend" section.

A few good ideas but overrated and very disappointing.

I've come to trust the reviews on amazon but i have to say that they are way off the mark for this particular book.
After trading for a few years, i've come to the belief that the simplest chart patterns are the best and you can find just about any pattern on a chart if you squint hard enough.
The authors would point out "ABCD" patterns after they have formed.
Perhaps the book was just poorly written but i just dont see the book helping any beginners and very few experienced traders.

Excellent Stock Trading Guide

"Trade What You See" provides an excellent overview for an individual who is interested in trading stock and commodity markets. Many books try and guarantee the perspective trader that the markets will provide you with riches and absurd returns. Instead the authors of this book are very careful to not provide the reader with wild exaggerations of potential market trading profits. The readers are provided with a clear and concise explanation of market patterns and the use of Fibonacci ratios in assisting a trader on when to enter and exit the market. Numerous pattern examples are given where the probability for a positive trade is significantly higher than 50% and how a trader should approach these situations.

"Trade What You See" covers in detail how to reduce the risk of losses through the use and placement of stops while minimizing the risk on any given trade. Throughout the book the writers are very careful to point out the pitfalls of trading and how to avoid large losses. The authors cover in detail a sound money management system and place it as the major key to becoming a successful trader. This is why this book is very well done.

There is no hype, just a pragmatic, objective approach to stock trading. Anyone who trades stocks or commodities needs a copy of this book. The book is very useful not just for "day" traders, but long term investors who want to know when to buy and sell stocks and avoid large losses. Even for a person who trades on fundamentals this book is an important guide.

If you purchase this book and follow the provided money management principles, you will certainly minimize your risk of incurring large losses in the stock market. This is why I found this book superior to other books I have read on stock trading.

Darwin Porter has given us another gift: The biggest, juiciest, hottest icon of 20th-century icon, Marilyn Monroe. In Marilyn at Rainbow's End: Sex Lies, Murder and the Great Cover-Up (Blood Moon Productions) Porter brings his talent for linking the obvious to the obscure, his memory for the most microscopic detail to the most comprehensible headline. And, in choosing Monroe, Porter has chosen a greater than life contemporary figure who touched every one of us, some more intimately than others. As always, the genius is in the detail. And Porter has all of them. Porter's honesty could rip the skin off of any figure, and give the reader the reality of all he writes about. Lust and fear---with a little greed and a touch of egotism―motors this work. Marilyn's climb―step by step, bed by bed (until she reaches the White House, Nikita Khrushchev and the heads of the Mafia)―is laid out in all its fantastic particulars. To be sure, there are other power mad fiends along the way, such as Sinatra, most of the Kennedy clan, Albert Einstein (!), sundry mobsters and monsters and politicians and pundits, all whom Marilyn used on her way up the ladder. Unfortunately, when you reach the tipity top of the ladder, the next step is down. And self-destruction. The more power you have, the more enemies you create; the more you know, the greater the danger. And Marilyn accumulated more power and knowledge than anyone else. That she would be murdered is obvious; the shock and surprise comes in how many people wanted her dead for so many reasons. Success in America comes with an awful price, and there really is such a thing as being too smart. Anyone who has ever believed the suicide theory must also believe in the Easter Bunny and Santa. The four-hour clean up after the body, not quite but pretty much dead, was discovered was clumsier than the Harlow clean up, with witnesses appearing and disappearing, stories changing and entire locations re-dressed for the occasion. At times, the cast of characters rivals any assembled by DeMille, with everyone from Peter Lawford to Robert Kennedy to a myriad of police officials. At other times, it was a very lonely place. It all depends on who you believe. With scrupulous research, Porter pretty much sums up the underside of American entertainment, political and criminal activities in middle of the twentieth-century. He does not paint a pretty sight, but Porter does present, with scathing honesty, the Monroe death lies and cover-ups, stopping just short of JFK and RFK. And for those who still believe that lone gunmen were responsible for the deaths of the Kennedy Brothers, is that the sound of sleigh bells on the roof? Porter is fearless, honest and a great read. He minces no words. He wouldn't suggest that a certain star was caught in flagrante delecto with an unnamed canine; he would simply state that that star was seen being screwed by a dog. Zing! Right to the point. If the truth makes you wince and honesty offends your sensibility, stay away. It's been said that Darwin Porter deals in muck because he can't libel the dead. Well, it's about time someone started telling the truth about the dead and being honest about just what happened to get us in the mess in which we're in. If libel is lying, then Porter is so completely innocent as to deserve an award. In all of his works he speaks only to the truth, and although he is a hard teacher and task master, he's one we ignore at our peril. To quote Gore Vidal, power is not a toy we give to someone for being good. If we all don't begin to investigate where power and money really are in the here and now, we deserve what we get. Yes, Porter names names. The reader will come away from the book knowing just who killed Monroe. Porter rather brilliantly points to a number of motives, but leaves it to the reader to surmise exactly what happened at the rainbow's end, just why Marilyn was killed. When You Self Publish & Everyone Is Dead, You Can Write Anything!

As much as I like Mr. Porter's books, you really can't take them as 'gospel.'

In this book, James Dean tells Marilyn (at Fire Island, no less) that while filming Giant with Elizabeth Taylor & Rock Hudson, he took a leak in front of 200 townspeople. Duh! James Dean DIED only days after filming Giant! How on earth could he be talking to Marilyn Monroe about it?! This is just one of numerous errors in the book. Such as the quote, "Jack will never leave Ethel." Did anyone proof read this before it was published?

As with all of his other 'biographies' of famous actors and celebrities, everyone sleeps with everyone else. Male, female, doesn't matter. Names are dropped on each page and they are quoted so precisely that Mr. Porter had to be a fly on the wall! Every person quoted in this book is dead. There is no one written about in this 'novel' to sue because they are gone!

You come away from reading this very long book (all his books are hundreds of pages) with the knowledge that Milton Berle was not the only 'star' with a super big bat. Not that it matters 'cause they died years ago! He needs to write a book about current actors who are well-endowed so some lucky gal (or guy) can find out for themselves if the information is correct. He can't. He'll be sued.

I give it 4 Stars because it IS entertaining. A perfect Summer beach or long weekend read. It's Memorial Day Weekend and between cookouts I am cramming in a few chapters.

The 'usual suspects' of much-quoted actors and actresses line the pages. Quotes from the 50s that didn't come into being until the 70s like, "You mean he made you an offer you couldn't refuse?" She died 10 years before this was written by Mario Puzo. But it's in the book. There are many, many mistakes. However, if you're in your 20's or 30's, you may not catch them. You wouldn't know the history timeline involved. Needless to say, the names of the Mafia guys will go way over everyone's head.

He names the men who murdered Marilyn and how they murdered her. Their murder weapon (an enema hose) has been written about before in other books or magazine articles. In this book, during the murder, there were people present in her house! Her housekeeper and the housekeeper's son! The Mafia was many things, but sloppy they weren't!

Mr. Porter did a great deal of research on Marilyn's films and her life. He must have read half a library on Peter Lawford, the Kennedy brothers, Frank Sinatra, Joe DiMaggio, and on and on and on. However, this doesn't mean what he has written is true or accurate. He sort of made up the dialogue as he went along. Which means, he's an excellent writer with a wonderful imagination. And those two assets are why his celebrity tell-alls are successful. You know they're total fabrications, but you don't care. Porter's books are total escapism of the best kind. And with all the negativity bombarding us 24/7 these days from all over the world, isn't that really what we yearn for?

The one truth that shines throughout all the biographies about Marilyn's life is that if she had been a secretary or waitress, she would have been put in a mental hospital very early in her life, and would have never been released. She was a very, very emotionally disturbed person. Everyone connected with her personally and professionally knew this. But she made so much money for them they sheltered us from just how bad off she was. Whether she overdosed on her own or was murdered, she never would have seen 40.

I distinctly remember how off-the-rails she was just before her death. Modern Screen, Photoplay, all the film mags were full of photographs of her romance with her Mexican lover and drunken appearance in Sinatra photos. She had been fired from Something's Got To Give and she looked 50 years old. The book claims she was far from over in Hollywood. Like almost everything in the book, it was wishful thinking. A Disney ending we all wish had been true.

I felt as though I was reading an X-rated novel. Such garbage. Really...conversations between dead people that can't be verified. It left me with a bad taste in my mouth about Marilyn and the trash talk. She's certainly not available to defend herself. I couldn't bring myself to read the book in it's entirety. There were certain areas that were interesting, but the author used such foul language in reference to her sexual life, conversations and descriptions about her, that it left me cold. Everyone was either gay, a sexual pervert, etc. I threw the book in the garbage. Wouldn't think of passing it on. Shame!!! Any fan of Marilyn should be outraged!

Marilyn Monroe EXPOSED

Darwin Porter has written an expose' with all the juicy tidbits and shocking revelations about the icon Marilyn Monroe. We're introduced to her private life as well as her public image. Her private life was a mess with sexual encounters with many famous and not so famous men and women. Her public image as an orphan and rags to riches life was protected and facts not made public by an adoring press for years. She was obsessed with President John F. Kennedy and his brothers Bobby and Teddy and met with them at different places throughout the 60's until her untimely and questionable death. She kept a diary (that has disappeared) and confided in a few friends of all her sexual escapades. She was beautiful and sexy and others imitated her.She knew how to use her sexuality to further her career and to ease her loneliness. She loved baseball's Joe DiMaggio who beat her at times. She married playwright Arthur Miller who she thought would be her savior. She loved Frank Sinatra and carried on an affair for years with him. He almost married her but claimed she had poor hygiene that turned him off. The book is chock full of information that is highly negative about her. And also the author writes about the cover-up of her death as being murder.She lives on in our memories and in her films and even in death she is irreplaceable.

First off, THIS IS A GREAT RESOURCE FOR YOUTH WORKERS to use with their students, especially if they are in a bind and dont want to just throw something together. these talks are very well thought out and real stories that will connect with teens.

With that said, after buying this book in print, I wanted to get this for my Kindle app on my iPad since the publisher chose not to include a CD with the book like the first one. After opening it up in my app, I saw that the content and talks in this new release (which are completely new and different in the print version than the talks in the first book that came out a few years ago) are just the talks from the first book! MAJOR SCREW UP BY THE PUBLISHER HERE! Amazon staff has been helpful as possible, but they can't do much about it because the Publisher (Zondervan) submitted an incorrect ebook for Amazon to deliver to buying customers.

I'm looking forward to the right version of this book for my kindle.

My youth love the lessons

I am always skeptical of pre-packaged youth lessons. I have been impressed with the lessons in this and the first of these books. The lessons that I have used have fostered conversation (one of the reasons I am skeptical), and have broad applicability both from a theological perspective and from an age-propriety standpoint. In particular, the lesson about Surrender had my youth talking even the following week, and led to wonderful discussions. Highly recommended.

Could she have been close to---have even known the successful bookie, his family, his bodyguards? The police have good reasons for looking at all the people in this psychological merry-go-round, and another attempted murder only complicates their work, spreading the suspicion to touch even more of the town's kaleidoscope of citizens.

As always, at the center of Curzon's suspenseful and puzzling story is the likeable, reliable Yeadings, as genuine a police officer as any you might find in the English countryside. He goes after his villains armed with a mix of experience and common sense---and real-life personal problems that only add to his believability. Readers can be certain that Inspector Yeadings and his sergeants will get their prey---if only after overcoming highly suspenseful odds.
